D018: Task 2 2
A. Algebra teacher violation of IEP
Sara has an IEP, Individualized Education Plan. In her IEP it states that she is to take her
exams in a one-on-one setting to ensure she is free from distractions during her test due to her
anxiety disorder. She is able to learn with her peers in the regular classroom setting for class but
has a special one-on-one setting for any testing she is to complete.
When Mr. Williams found out there was a substitute, he went against the IEP and sent
Sara to a location that was small in testing size, and with an adult she was familiar with, thinking
he was doing her the better accommodation. However, he did not follow Sarah’s IEP. An
Individualized Education Plan must have “a statement of the special education and related
services and supplementary aids and services…to be educated and participate with other children
with disabilities and nondisabled children”. (Individuals with Disabilities Education Act, 2026).
When Mr. Williams went against the IEP he in turn denied Sarah FAPE benefits. “the primary
vehicle for providing FAPE is through an appropriately developed individualized Education Plan
(IEP) that is based on the needs of the child (Individuals with Disabilities Education Act, 2026).
An IEP is a legally binding document that the school must follow for Sarah to receive the access
to equal education. When Sara’s parents found out that the IEP had not been followed, it proves
that, despite Mr.Williams feeling it would be in best interest to have her in a room with other
students and teachers she knew, the school is out of compliance due to the IEP not being
followed and it being a legally binding document for Sara.
