WHAT CONSTITUTES DISCRIMINATION - Answer: While discrimination is not defined in the code courts have recognized it as both intentional acts of exclusion and hidden or unintentional acts: - section 11 of the code recognizes constructive discrimination, also called adverse impact discrimination.
