Florida responded in 1985 with passing the Comprehensive Medical Malpractice
Reform Act. It created requirements it prior to filing a medical malpractice lawsuit. These
requirements include providing notice of intent to prospective defendants and you have
to engage in pre-suit discovery, which encourages the parties to settle early.
Florida was bifurcated because the state's loss rate was so high. What does bifurcate
mean and what did Florida do?
Bifurcate means to divide into two branches. Florida bifurcated into two sections. They
