Rockwell Real Estate Exam Prep Ch.1 Flashcards What are riparian rights?Riparian rights are tied to land ownership.Under the riparian rights system, a landowner has the right to use the water that touches her property for domestic purposes.Domestic purposes include bathing, washing clothes, or watering your vegetable garden.What are the three main methods of legal description?Metes and boundsGovernment surveyLot and block What is riparian water?Riparian water is flowing water, such as the water in a river, stream, or creek.Define real propertyReal property is land, anything attached or affixed to the land, and anything incidental or appurtenant to the land.Real property is also called "realty." What are the 2 types of support rights?Subjacent support is provided by the underlying earth.Lateral support is provided by neighboring land.What is included in leasing a property?Selling the right to possess and use property for a period of time is called leasing the property.Limitations on riparian and littoral rights The water may be used only on the riparian or littoral property itself.It can't be transported for use elsewhere, on property that doesn't adjoin the river, lake, or other water source.What is the rectangular survey system?In the rectangular survey system (also known as the government survey system), the land is divided into a series of grids and each grid is identified by its principal meridian and base line.What are support rights?Support rights refer to the natural support provided to a piece of land by the surrounding land.Real property vs. personal propertyReal property is included in the sale and personal property belongs to the sellers.What does "real property" include?Real property includes not only the land itself, but also the things and the rights that go along with ownership of the land.What are township lines?The east-west lines that parallel the base line are called township lines. They divide the land into rows called township tiers.

What is the Doctrine of Emblements?The doctrine of emblements is a special legal rule pertaining to crops. The doctrine applies when agricultural land has been leased to a tenant farmer. Emblements are crops planted annually by a tenant. Under the doctrine of emblements, if the lease terminates (through no fault of the tenant) before a crop is mature, the tenant has the right to re-enter the land later to harvest the first crop that matures after the tenancy terminates.What are the four basic appurtenances?Air rightsWater rightsMineral rightsSupport rights What is the metes and bounds method?In a metes and bounds description, monuments, courses, and distances are used to define the property's boundaries.The description must start at and return to a point of beginning.What is Washington's Meridian Line called? Willamette Meridian What is the lot and block method?Property on subdivided land is identified by its lot and block numbers as shown on the plat map that the developer recorded. Nearly all properties in developed areas can be described with the lot and block method.What does a bundle of rights include?Bundle of rights includes the right to possess, use, enjoy, encumber, will, sell, or do nothing at all with her property.What is littoral water?Littoral water, on the other hand, is standing water, such as a pond or a lake. This term also applies to tidal waters, such as Puget Sound or the ocean.What is the rule of capture?Any oil or gas produced from wells located on a landowner's property become the personal property of that landowner. This is true even if the wells caused the oil or gas to migrate from underneath neighboring property.What is the government survey method?A government survey (or rectangular survey) description identifies the property by its position within a particular section, township, and range. The description must also include the name of the principal meridian.Prior appropriation systemUnder the prior appropriation system, someone who wants to use water from a river, lake, or other source must apply to the state for an appropriation permit. Common in areas where water is more scarce, including eastern Washington.What is an appurtenance?An appurtenance is something that goes with or pertains to ownership of a piece of real property, but isn't necessarily a physical part of the property.What are range lines?On each grid, there are gridlines running parallel to the principal meridian and to the base line at intervals of six miles. The north-south lines are called range lines.What must a complete government survey description include?A complete government survey description for a particular piece of property must include the section, township, and range. It must also include the name of the principal meridian, to identify the grid.
