IMSA Amstud constitution Test

1. Confrontation Clause:

Answer in a criminal proceeding the defendant has the opportunity to face the witness and cross- examines them, to object to the testimony. It is designed to prevent a defendant from being convicted based on written evidence without having the opportunity to face their accuser and test their honesty and truthfulness before a jury.

2. Advice and consent:

Answer Reserves to the Senate power and oversight over certain activities of the executive branch.The senate can tell the president no and the president has to listen.

3. Speech and debate:

Answer Protects members of Congress from having to worry that anything they say in the course of legislative activities will implicate them in a lawsuit. Congressmembers cant get sued for things (within reason) that they say in session (ex.Pepsi cant sue Senator Jim for saying that he’s not going to vote for a bill because Pepsi is gross while on the Senate floor)

4. Commander in Chief clause:

Answer The president can tell the Army and Navy when they're in active service what to do and they have to do it.

5. Copyright Clause:

Answer Authors or inventors can claim right to their work and have it so that no one else takes credit. Usually last for 70 years after creator dies but not always.

6. General Welfare Clause:

Answer Congress has the right to create and enforce taxes, duties, imposts, excises, etc, to 1 / 2

provide for the welfare and defense of the United States and pay off debts.

7. Fifth amendment Due Process clause:

Answer Requires the COURT to respect all rights and protections afforded by the U.S.Constitution and all applicable statutes and give fair and just judicial proceedings.

8. Fourteenth amendment Due Process clause:

Answer The STATE cant make or enforce any law interfering with the privileges or immunities of citizens of the United States or deprive any person of life, liberty, or property, without due process of law or deny to any person within its jurisdiction the equal protection of the laws.

9. Interstate Commerce Clause:

Answer Gives Congress the power to regulate commerce with foreign countries, between states, and with Natives on reservations

10. Spending Clause:

Answer Congress has the power to tax citizens to pay debts and provide for the common defense and general welfare of the United States. Can be used to withhold funding from states.

11. Equal Protection Clause:

Answer The government has to treat all people equally. Clause only talks about certain groups though.

12. War Clause:

Answer Gives Congress the power to declare war, allow Marque and Reprisal (the head of a government authorizes a private ship to capture enemy vessels), make rules concerning land and water
